Are LED headlights dangerous?

New safety features are constantly implemented in passenger and commercial vehicles. While many of the technological advances utilized to create these safety features are effective, over time several of them have had their efficacy drawn into question. Now, LED headlights may be in the crosshairs after an individual filed a lawsuit against the FDA, accusing it of failing to set appropriate standards for these products.

What does the lawsuit claim?

The claim, filed in federal court in California, alleges that the FDA has failed to set standards on the release of radiation from LED-based products and to set performance standards for LED lighting. More specifically, the claim alleges that the FDA needs to address issues like square wave flicker, light dispersion, power distribution, and flash characteristics.

According to the plaintiff, unaddressed, these issues, in addition to the release of electromagnetic radiation, pose a threat to consumers. This includes an increased risk of macular degeneration, cancer, obesity, mood disorders, and eye strain. And, given the extensive use of LED products in car headlights, streetlights, home-use light bulbs, and televisions, nearly everyone is subjected to the risk, according to the claim.

Where does the lawsuit go from here?

The case is still winding its way through the federal court system, so it’s hard to say with certainty how the issue will play out. If the plaintiff is successful on his claim, then stricter regulations may be put in place, which may dim the brightness of LED lights or restrict their overall use. Although unlikely, the FDA could choose or be forced to ban the use of LED bulbs in new products.

That said, the plaintiff likely has an uphill battle here. He represents himself without an attorney, and he’ll be going up against a highly skilled legal team from the federal government. But only time will tell whether he’s able to convince the federal courts that the FDA has strayed from its obligations under Federal Food, Drug, and Cosmetic Act as well as the Radiation Control for Health and Safety Act.

What does this mean for you?

At the moment, this lawsuit probably has little to no impact on your daily living. However, it could have implications if new standards are implemented. In that case, you may have to change the headlights in your car and the lighting in your home, or you might be justified in taking legal action against someone who used the wrong type of LED lighting if such use causes a car accident. Until that time, though, if you’re injured in a car accident, then you’ll have to present the standard evidence necessary to prove negligence and causation.
